Visas for the UK - Points Based System
Applying for your visa for the UK is the most important process you will undertake in order to gain employment in the UK. PK Immigration Lawyers will assist you throughout your UK visa application to ensure that everything is in order. Our immigration solicitors can give you immigration advice throughout your case, no matter how trivial.To apply for your visas for the UK under the Points Based System (PBS), you will need to fit into one of the Home Office's Tiers. Most immigration categories are covered by the Points Based System (PBS) and our immigration solicitors will assess your case individually and advise the best tier to apply for.
TIER 1 - UK Visas for Highly Skilled Migrants - Tier 1 visas allow highly skilled workers (formerly HSMP), entrepreneurs, graduate students and business investors to work for any employer or be self-employed in any capacity in the UK. There is no need for an employer to sponsor a Tier 1 visa.
TIER 2 - UK Visas for Skilled Migrants (Work Permit) - Tier 2 visas replace the Work Permit scheme. You need an offer of employment (certificate of sponsorship) from a UK employer before you can apply for this visa.
TIER 3 - currently suspended
TIER 4 - UK Student Visas - Tier 4 visas replace the student visa category and allow individuals to study in the UK. If students are successful at a suitable level in theur studies, they have the potential to apply for a Tier 1 visa.
TIER 5 - UK Visas for Temporary Workers and Youth Mobility - Tier 5 visas allow for up to 2 years working in the UK for those aged between 18-30 from qualifying countries. This replaces the Working Holiday Visa.

Our immigration solicitors can assist you with all aspects of becoming a UK resident.Indefinite Leave to Remain - commonly known as UK residency. You need a minimum of 5 years continious residence in the UK on a visa that leads to settlement. There will be no time limit or conditions on your stay.
Citizenship - must be aged 18 or over, lived in the UK for at least 5 years and not spent more than 450 days outside the UK in the past 5 years and no more than 90 days outside in the past 12 months.
Naturalisation - this occurs when you become a British citizen and receive your British passport.
Settlement - usually happens when you have been resident in the UK for more than 4 years on the same visa class (excluding student visas and marriage and de facto visas).
Appeals & Refusals
If your application to enter or remain in the UK is refused then you may have a right of appeal against this decision to the Asylum and Immigration Tribunal. This is a court system dedicated to immigration and asylum matters where you case will be heard by an immigration judge.This is your opportunity to get the Home Office or Entry Clearance Officer's negative decision changed and you will have the opportunity to put your own view forward. It is advisable to seek legal representation to make sure that your voice is heard and documents presented to enable a judge to allow your appeal.
